These terms and conditions (these "Conditions") apply to all applicants (each an "Applicant") applying for a short term period visa not exceeding 90 days as well as a long term period visa exceeding 90 days to travel to Italy from the relevant countries for which VFS provides the services of a logistics agent. References in these Conditions to VFS include a reference to the employees, servants and agents of VFS whether or not acting within the scope of their contractual obligations, agency or employment. References to an Applicant include a reference to the Applicant's personal representatives, heirs and assigns.

VFS is a service provided by VFS (Kenya) Ltd.

VFS merely acts as a logistics agent with responsibility to receive from an applicant applying for  a short term period visa not exceeding 90 days as well as a long term period visa exceeding 90 days to travel to Italy, the Applicant's passport, duly completed visa form, supporting documentation ("Documents") and the applicable fees. VFS is responsible for submitting the duly completed application and other Documents to the Embassy of Italy in Nairobi, on behalf of the Applicant, and to the extent VFS is permitted to do so, collect the Documents from the Embassy of Italy in Nairobi and return the Documents to the Applicant by hand delivery from the office where the application was launched. The Applicant acknowledges that not all Documents submitted to the Embassy of Italy in Nairobi may be returned, depending on the policies of the Embassy of Italy in Nairobi.

The Applicant acknowledges that the Embassy of Italy in Nairobi reserves the right to ask for further documentation and to reject the visa application. By accepting to act as Logistics Agent, VFS does not undertake or guarantee the success of any application.

Note: There are circumstances where the Embassy of Italy in Nairobi will hand over the Documents or some of them to the Applicant directly.

Save as expressly provided herein, VFS is not responsible for, and hereby excludes, all liability in respect of any injury, loss or damage of any kind whatsoever arising from any delay in processing or rejection of the visa application. Whilst reasonable precaution is taken while handling the passport of Applicants and important documents submitted in support thereof, VFS will not be liable or responsible whether in contract, tort or in any other manner, to the Applicant for any injury, loss or damage of any kind whether arising from:

	the handling of the Documents by VFS;
	any Act of God
	any accident of any kind, theft; or
	any other circumstance whatsoever

The Applicant accepts that the courier acceptance and delivery service is operated by a third-party, and VFS does not assume any responsibility or liability for any negligence or deficiency in service on part of the Courier Company or agent.

In case a Passport is lost or damaged in transit, the liability of VFS is restricted to reimbursement of official fees charged by the relevant authority, for replacement of lost / damaged passport through normal application procedure. VFS shall not be responsible or liable for any consequential loss or damage caused to the Applicant due to loss of his/her Passport and supporting documents.

It is expressly understood that when the Applicant or representative of the Applicant submits the Documents along with the applicable fees, the Applicant has understood the terms, conditions and details herein. The applicant acknowledges that VFS's obligations and liabilities are indicative and are in lieu of and to the exclusion of any warranties, conditions, terms, undertakings or representations of any kind, express or implied.

Application fees and related charges once paid by the Applicant are not refundable under any circumstances.

VFS advertising material may accompany the Documents where these are returned to the Applicant. If the Applicant does not wish to receive any advertising material along with the Documents returned, the Applicant must inform VFS in writing in advance. Please note that no advertising material sent with the Documents has the endorsement of any Government or the Embassy of Italy in Nairobi.
No employee of VFS may change / amend / amplify the conditions mentioned herein. The construction and validity of these Conditions shall be governed in all respects by Kenyan law and any disputes arising from these Conditions shall be submitted to the exclusive jurisdiction of the Kenyan courts.

The Applicant hereby agrees to these Conditions and confirms that he/she understands fully the meaning and effect of these Conditions.

Declaration:
I hereby wish to apply for a Visa to Italy. I have submitted documents that I feel are satisfactory in support of my visa application, together with the application form. I am aware that FedEx is offering only courier services and have no role whatsoever in the processing of my application. I am presenting to VFS my documents for them to forward to the Embassy of Italy in Nairobi.

I am also aware that the Italy Visa Application Centre shall upon receipt of my documents and visa application, forward the same to the Embassy of Italy in Nairobi, who shall in its sole discretion either grant a visa or schedule an interview or refuse grant of a visa. I am also aware that my passport and supporting documents shall be available for collection by me from the VFS office. I am also aware that the turn around time indicated by VFS is subject to all my documents being in order and the decision of the Embassy of Italy in Nairobi and I agree to abide by the same.

I have made this declaration on my own volition and is independent of any circumstances or factors which may vitiate the same.

Documents submitted:

	Valid passport with passport in suitable condition and one blank page in the passport.
	Photograph
	Bank cheque or bank payment slip for the Visa fees.
	Requisite forms duly completed
	Supporting documents
