Introduction

Welcome to the website of VFS Global Services Pvt. Limited (here in after for the sake of brevity referred to as VFS Global). Visa applicants and users are urged to read the Disclaimer Policy, User Terms and Conditions and the Privacy Policy. The use of this website and services provided by VFS Global are subject to the acceptance of the same by the visa applicant/user. VFS Global provides logistic and visa process facilitation services to FIMS applicants/users applying for and is responsible only for the following:

• Receiving from FIMS applicants completed FIMS application form, supporting documentation (collectively, the "Documents") and the applicable fees, and returning the passports upon receipt to visa applicants across the counter in person or by courier to an address provided by the visa applicant on the FIMS form or to such identified point of delivery as determined by VFS Global.

FIMS applicants are urged not to approach or use services of unauthorized persons, entities and touts. FIMS applicants are also advised against divulging any information relating to payment receipts, passport particulars and related details to any third persons. FIMS applicants alone shall be responsible for any resultant consequences and may also become liable for appropriate prosecutions and liabilities.

User Terms and Conditions

Notwithstanding anything to the contrary, the IMS/NIA the right to ask for further documents, information and material to assess the applications and in its own discretion decide on the basis of such information, material and documents submitted or furnished.

VFS Global is neither involved in the process nor is it liable for any decision nor is it responsible in any manner whatsoever for any delay in processing or granting or rejecting the visa as this is the sole prerogative of the Embassy/Consulate

While VFS Global takes every reasonable care and precaution in handling and delivering the Documents of visa applicants, VFS Global shall not be responsible for any loss or damage to the documents including passport/s (“Documents”), for any reason whatsoever or in any manner howsoever (save where it is proven in a competent court of law that the loss or the damage was due to the willful, intentional or reckless act of VFS Global or any of its staff acting in the course of their employment). Further, VFS Global shall not be responsible in any manner whatsoever to any visa applicant/s for any Documents lost in transit by accident, theft, natural calamities (acts of God) or any other reason outside the control of, or not arising out of any willful act or default by VFS Global. VFS Global does not warrant or guarantee the delivery of the Documents, material or information as a visa applicant may require, but will extend and provide services to the extent and to the points as notified and communicated to a visa applicant.

The access and/or use of the Denmark-Ghana website www.vfsglobal.com/nia/ghana name of the website) is at the discretion of VFS Global and use by anyone may be restricted or terminated by VFS Global at anytime.

VFS Global may engage third party entities such as courier companies for the movement of Documents between the visa applicants and the Embassy/Consulate. The visa applicant agrees and accepts that the courier acceptance and delivery service through which the documents are received or returned to users by VFS Global is operated by a third-party. VFS Global does not control or operate such courier companies or their services, neither does it control nor operate any facility/ service provided by such courier companies

VFS Global expressly disclaims any and all liability for any delay, loss or damage caused to the visa applicant/user in the event that such visa applicant/user’s Documents are delayed/misplaced/lost/damaged by the courier company, whether such delay/misplacement/loss/damage results from negligence, accident or any other cause whatsoever. In no event shall VFS Global and/or its representatives be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever due to such delay/misplacement/loss/damage of the Documents, including but not limited to the visa applicant’s passport. It is understood that courier services are arranged only on the request of visa applicant/s and VFS assumes no obligation for the same. Applicants remedy, if any will be only against the courier company and the visa applicant/s consents to the same. Without prejudice to the aforesaid, the total liability of VFS Global, if in an event any Documents are lost or damaged in transit, is limited/restricted to the reimbursement of the amount of the actual fees charged by the respective department or such competent authority , for the replacement of a lost/damaged passport through the normal passport application procedure. Such reimbursement of the fee amount will be made by VFS Global to a visa applicant only on the presentation by the visa applicant of a valid proof of payment.

By using the services available from the domain and sub-domains of the Site, the visa applicant /user agrees to the following terms and conditions, including those available by hyperlink (the "Agreement" or "User Agreement") with VFS Global and the website/s of its affiliate/s, joint venture partner/s, agencies, subsidiaries and clients. If you reside outside India, you are contracting with VFS Global Services Pvt. Ltd., its affiliate/s, joint venture partner/s, agencies, subsidiaries and clients and agree to be bound by the terms and conditions herein. Before you proceed to use the services provided by VFS Global and its affiliates, joint venture partners, agencies, subsidiaries, and clients, you must read and accept all terms and conditions in, and linked to, the User Agreement, Disclaimer Policy and the Privacy Policy to be able to proceed further to utilize the services provided by VFS Global Services Pvt. Ltd. VFS Global strongly recommends that, as you read the User Agreement, you also access and read the linked information

Do not use the Site if you cannot or are barred from entering into legally binding contracts or you are under the age of 18 or are temporarily or indefinitely suspended or prohibited from or accessing or using this or the linked sites as may be applicable;

By accepting the User Agreement, you agree that your use of VFS Global website and websites related and linked to VFS Global Website will be governed by the user agreement/s, Disclaimer and privacy policies posted on that website/s with such changes and modifications as may be made from time to time.

Prohibition against unlawful use

While accessing or using www.vfsglobal.com/nia/ghana (the "Site"), the user will not:

• Post any content or items in an inappropriate category or areas on the Site nor post any material in whatsoever form, on the Site for any purpose other than the normal purpose for which the Site is intended;
• Violate any laws, third party rights, or policies of VFS Global . The user shall not hide or spoof his/her IP address or intentionally or bounce his/her communications through any intermediate computers. The user shall also not alter the logs upon gaining access;
• Interfere with the technological operations of the Site or attempt or manipulate the content or material on Site or of any other user or users;
• Use any robot, spider, search engine, scraper or other means whether manual, automated, mechanical, electrical or electronics either existing or that may be invented or discovered to access the Site and/or to do any of the acts mentioned above for any purpose other than the normal purpose for which the Site is intended;

Additionally, user agrees not to:

• Take any action that imposes or may impose (in our sole discretion) an unreasonable or disproportionately large load on VFS Global ’s infrastructure;
• Interfere or attempt to interfere with the proper working of the Site or any activities conducted on the Site; or
• Bypass our robot exclusion headers or other measures we may use to prevent or restrict access to the Site.
• Do or take any action that may undermine the feedback or ratings systems, such as displaying, importing or exporting feedback information of the Site or for using it for purposes unrelated to VFS Global ;
• Access or attempt to gain root access, use any manual, mechanical, electrical or electronic means, computer programs, exploits, hacker tools, or scripts, software or hardware tools, search engines either existing or that may be invented either directly, indirectly or through any contrivance to change, modify, post, violate, misuse, abuse, erase, hack, distort, slow down, configure any system, website, to work for them, or to cause denial of services to other users or on other computers or down the Site or its user features;
• Send, post, plant or distribute viruses or any other technologies that may harm VFS Global , or the interests or property of users;
• Copy, modify, or distribute content from the Site and/or VFS Global 's copyrights and trademarks or other intellectual property;
• Harvest or otherwise collect information about other users, their details, or any information relating to any other user’s passport details, email addresses, etc.

In case of any unlawful, illegal or prohibited use, the user shall be liable for action under Indian and Ghanaian laws as amended from time to time.

Limitation of use

Without limiting other remedies, VFS Global may at its sole discretion or at the advise or under the directions of its clients limit, suspend, terminate temporarily or permanently, disable or prevent a visa applicant/user from accessing/making use of its service, prohibit access to its website/s, remove hosted content, and take technical and legal steps to keep user/s off the Site if VFS Global thinks that the user is or is attempting to resort to abnormal usage or abuse, creating problems, potential or otherwise or possible legal liabilities, or is not acting consistently with the normal usage.

Content license

When the visa applicant/ user provides VFS Global content which shall include personal information of user and audio signals / video images of the visa applicant/user captured at the VFS Visa Application Centre (User Information) and/or stored in CD/DVD and made available to the Embassy/High Commission when required, the visa applicant/user hereby gives consent to VFS Global for using the all such Information and/or storing such User Information and making available to the Embassy/High Commission when required and grants VFS Global a non-exclusive, worldwide, perpetual, irrevocable, royalty-free and sub licensable right to exercise the copyright, publicity, and database rights the user has in the User Information, in any media known now or in the future. Visa applicant gives full consent VFS to capture audio signals / video images at the Visa Application Centre, transmit and stream the same on real time or quasi real time basis, store and/or make available recordings of such audio signals/video images on CD/DVD format or any other medium to any place whether in India or otherwise in any mode for purposes relating to the visa facilitation process. VFS has taken necessary steps to implement and maintain security practices and procedures to protect User Information from unauthorized access, damage, use, modification, disclosure or impairment. VFS has in place suitable protection mechanism and guidelines for usage, retention and protection of User Information against unauthorized access, disclosure or abuse.

Disclaimer of warranty

While VFS Global makes and strives to provide secure and continuous connectivity and internet access, VFS Global, the Embassy/Consulate and/or its clients shall not be responsible or liable to a visa applicant/user for any loss or consequential damage, including among other things, any loss of dates obtained, time, data or information furnished or entered on the website or the application forms, etc which may, among other things, have occurred as a result of any events or acts leading to interruptions in internet connectivity, transmission of signals, server breakdown, systems crashing, hacking, servicing and any other events or acts. Visa applicant/user agrees not to hold VFS Global responsible for other users' actions or inactions, including acts or things as a result of which there may be loss of connectivity, loss of dates and/or loss of data furnished.

Further, while secure and continuous access to the service is sought to be provided, VFS Global does not guarantee continuous or secure access to its services and operation of the Site, as the same may be interfered by numerous factors outside the control of VFS Global. Accordingly, to the extent legally permitted, VFS Global excludes all implied warranties, terms and conditions. VFS Global is not liable for any loss of money, time, goodwill, or reputation, or any direct, special, indirect, or consequential loss or damages arising out of the visa applicant/user’s use of its website.

Indemnity

The visa applicant/user agrees to indemnify and hold VFS Global, its officers, directors, agents, subsidiaries, joint venture partners and employees, harmless from any claim or demand, including reasonable attorneys fees, made by any third party due to or arising out of the breach of this Agreement, or violation by the user of any law of any country or the rights of a third party

Notices

Except as explicitly stated otherwise, legal notices shall be served on VFS Global’s authorized agent at: Kamalacharan Building, Plot No. 179/180, Jawahar Nagar, Goregaon(W) Mumbai 400 062, Maharashtra, India and to the visa applicant/user at: the email address and/or address provided to VFS Global during the online registration process. Notice is deemed given 24 hours after an email is sent. VFS Global may issue legal notice by email or to the address provided during the online registration process.

Beware of fraudulent job offers

Fraudulent Recruitment / Employment Offers

It has come to VFS Global’s attention that, individuals misrepresenting themselves as VFS Global’ agents or representatives have approached people to offer fraudulent/fictitious employment opportunities, with the intent to steal personal information or solicit money from people. We encourage you to exercise caution and common sense when receiving any such employment offer, which requires payment of any fees/money, or promises a work visa in exchange for money. The said offers are completely fake and not valid. VFS Global is not a Recruitment agency and does not offer recruitment services. Scammers operate primarily via the internet, email, phone etc. We warn people to beware of such scams.

Please be advised that, VFS Global is a visa processing company and we work only with government and diplomatic missions to fulfil their administrative requirements of visa application processing. Neither VFS Global nor its representatives will ask for money from individuals under any circumstances to lure them with employment opportunities either in VFS Global or outside. If you receive any offer that purports to be from VFS Global, which ask for money, these types of offers are fraudulent.

Warning signs of recruitment fraud

The following are some examples of recruitment fraud which are in violation of VFS Global’s processes and ethical practices:

• The email is not sent from an official VFS Global e-mail address but from a free e-mail service such as: Hotmail, Gmail, Outlook, Yahoo, etc. It is also possible that, the email is sent from a fake email address.
• You are asked to disclose private or confidential information.
• You are asked to be interviewed over the phone or via an instant-messenger type program.
• You are requested to pay fees/money.
• You are requested to complete bogus recruitment documentations such as an application or employment visa forms, (the VFS Global name and logo could be forged/fabricated and featured on the documentation without authority).
• Insistence on urgency.
• Money will be requested for processing Work Permits, Visa applications or the like.

Such actions are presumably intended to defraud or obtain personal information from the victims.

The activities of these individuals involve criminal and civil liabilities. While VFS Global takes such matter seriously and reserves its right to contact competent law enforcement agencies to investigate and prosecute such illegal activities, it is often difficult to locate and prosecute these individuals.

Therefore, if you receive a request, either in writing or verbally, for an interview or a job offer that you believe is or might be fraudulent or suspicious, please disregard them. You may also verify the same with VFS Global at communications@vfsglobal.com

If you come to know that a fraud is being perpetrated, we encourage to forthwith contact your local police and/or any competent authorities and also to keep us informed by reporting the fraud at acco@vfsglobal.com

Under no circumstances will VFS Global be liable or responsible for any loss, damages, expenses or inconvenience resulting from these unauthorized persons and/or activities.
